These Terms of Service ("Terms") govern your access to and use of the Bartr mobile application, website, and related services (together, the "Service"), provided by Bartr B.V., a private limited liability company incorporated in the Netherlands ("Bartr", "we", "us", or "our"). By creating an account, downloading the app, or using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.
These Terms were last updated on April 10, 2026, and are effective from that date.
Who can use Bartr
You must be at least 18 years old to create an account or use the Service. If you are under 18, you may not use the Service under any circumstance. We do not knowingly allow minors to register, and accounts discovered to belong to minors will be terminated.
You must also:
- Have the legal capacity to enter into a binding contract in the jurisdiction where you reside;
- Not be barred from using the Service under the laws of the Netherlands, your country of residence, or any other applicable jurisdiction;
- Not be on any sanctions list maintained by the European Union, the United Nations, or the Government of the Hong Kong Special Administrative Region.
Businesses, companies, and legal entities may not create accounts at this time. Bartr is a service for individuals only.
Your account
To use Bartr you must create an account using an email address, Apple ID, or Google account. You are responsible for:
- Maintaining the confidentiality of your login credentials;
- All activity that occurs under your account;
- Notifying us immediately at support@bartr.it.com if you suspect unauthorized access.
You may have only one account. Creating multiple accounts to circumvent rate limits, suspensions, or the one-item unlock gate is prohibited and will result in termination of all associated accounts.
You may delete your account at any time from within the app. Account deletion removes your listings, your profile, and your direct messages from public view, and triggers the retention timelines set out in our Privacy Policy.
What the Service does
Bartr is a platform that enables users in dense geographic communities — such as universities, residential towers, and neighborhoods — to discover, match, and coordinate in-person trades of goods with other users nearby.
Core Service functionality includes:
- Listing items you no longer need (one-item minimum unlocks the app);
- A matching engine that surfaces trade opportunities across your building, campus, or neighborhood;
- AI-assisted listing, valuation, and match suggestions via AI Buddy;
- Community channels for your building, campus, and city;
- In-app messaging between users to coordinate meet-ups;
- Trust scores based on completed trades and user ratings;
- The Boot — an in-app feature that allows either user to specify a cash top-up amount as part of a trade agreement.
Bartr is a platform, not a party to trades. Bartr does not own, sell, buy, transport, insure, authenticate, or guarantee any item listed or traded on the Service. Bartr does not process payments, does not hold user funds, and does not act as a payment service provider. All trades, including any cash component via The Boot, are private agreements between users.
Listings and User Content
You may post listings, photographs, text descriptions, messages, ratings, and other content (together, "User Content") to the Service. You warrant and represent that:
- You own the items you list, or have lawful authority to dispose of them;
- Your listings are accurate and not misleading;
- Your photographs are of the actual items being offered;
- You have the right to share any User Content you upload;
- Your User Content does not infringe any third party's intellectual property, privacy, publicity, or other rights;
- Your User Content does not contain malicious code, unlawful content, or content that violates § 06 below.
You retain all ownership rights in your User Content. However, by posting User Content to the Service, you grant Bartr a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, adapt (for formatting and display purposes), and distribute your User Content solely for the purposes of operating, promoting, and improving the Service. This license ends when you delete the relevant User Content, except where retention is required by law or is necessary to resolve disputes or enforce these Terms.
Bartr does not pre-screen User Content but reserves the right (but not the obligation) to remove or modify any User Content that violates these Terms, at our sole discretion.
Prohibited items
You may not list, offer to trade, or trade the following items on the Service:
- Weapons and ammunition of any kind, including firearms, knives above legally permitted blade lengths, tasers, pepper spray where restricted, and any item designed to cause physical harm;
- Drugs, controlled substances, prescription medications, drug paraphernalia, or legal highs (whether or not legal in your jurisdiction);
- Alcohol and tobacco products, including vapes and e-cigarettes, where restricted by local law;
- Counterfeit goods or items that infringe trademarks, copyrights, or other intellectual property rights;
- Stolen property or items you do not have the right to dispose of;
- Live animals, animal parts, or products derived from endangered species;
- Human remains, body parts, bodily fluids, or biological materials;
- Hazardous materials, including explosives, fireworks, flammables, corrosives, radioactive materials, or items that cannot be legally transported;
- Adult content, sexual services, or items of a sexually explicit nature;
- Personal data, identity documents, passports, drivers' licenses, or financial instruments (credit cards, bank cards, cheques);
- Digital goods, cryptocurrency, gift card codes, software licenses, accounts, or subscriptions;
- Tickets to events, travel, or services where resale is restricted;
- Recalled products or items subject to product safety recalls in any jurisdiction;
- Medical devices, prescription eyewear, or items requiring regulatory clearance;
- Items that cannot be legally traded in either party's jurisdiction.
This list is illustrative, not exhaustive. Bartr reserves the right to remove any listing at its sole discretion.
Prohibited conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- Harass, threaten, intimidate, defraud, stalk, or otherwise harm any other user;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Circumvent, disable, or interfere with security features, rate limits, or the one-item gate;
- Scrape, crawl, harvest, or extract data from the Service using automated means;
- Reverse-engineer, decompile, or attempt to extract the source code of the app;
- Upload viruses, malware, or any malicious code;
- Create listings that are deceptive, fraudulent, or intended to lure users into off-platform scams;
- Use the Service to send unsolicited messages, spam, or marketing content to other users;
- Solicit or collect personal information from other users beyond what is necessary to complete a trade;
- Encourage or coordinate violations of these Terms;
- Use the Service in any manner that could damage, disable, overburden, or impair it.
Violations may result in immediate account suspension or termination, removal of User Content, and in serious cases, referral to law enforcement.
Trades between users
Any trade you enter into through Bartr is a private agreement between you and the other user. Bartr is not a party to the trade, does not mediate disputes arising from trades (except as expressly provided in § 08), and offers no warranty as to the condition, authenticity, ownership, safety, or value of any item.
You are solely responsible for:
- Verifying the identity of the person you are trading with before meeting;
- Meeting in a safe, public, or well-trafficked location;
- Inspecting the item before completing the trade;
- Complying with all applicable tax, customs, and reporting obligations arising from the trade.
The Boot
If a trade includes a cash top-up ("The Boot"), the cash transfer happens directly between the two users at the point of the in-person trade or via their own payment methods outside the Service. Bartr does not process, transmit, hold, or guarantee any cash payment. Bartr is not a payment service provider, electronic money institution, or money transmitter under Dutch, EU, or Hong Kong law.
You acknowledge that in-person meet-ups carry inherent risks. Bartr strongly recommends meeting in public spaces, informing someone of your meeting plans, and trusting your judgment about any meeting that feels unsafe.
Ratings, reviews, and Trust Scores
After a completed trade, both users may submit a structured feedback form and a star rating. Feedback must be truthful, based on first-hand experience of the actual trade, and free of defamatory, discriminatory, or abusive content.
Bartr calculates a Trust Score for each user based on completed trades, response rates, and rating history. Bartr reserves the right to withhold, adjust, or reset Trust Scores where we detect manipulation, fraud, or violations of these Terms.
You may not:
- Submit ratings for trades that did not occur;
- Coordinate with other users to artificially inflate or deflate Trust Scores;
- Use ratings or reviews to harass, extort, or retaliate against other users.
Ratings are not warranties of future conduct. A high Trust Score does not guarantee a safe or satisfactory trade.
Intellectual property
The Service — including the Bartr name, logo, wordmark, app interface, matching algorithm, AI Buddy, designs, code, documentation, and all other materials (excluding User Content) — is owned by Bartr and protected by copyright, trademark, and other intellectual property laws in the Netherlands, the European Union, Hong Kong, and internationally.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use, solely in accordance with these Terms. This license does not permit you to:
- Copy, modify, or distribute any part of the Service;
- Use the Bartr name or logo without prior written permission;
- Create derivative works based on the Service.
All rights not expressly granted are reserved.
Third-party services
The Service is distributed via the Apple App Store and uses third-party infrastructure including cloud hosting, authentication providers (Apple, Google), AI processing providers, and analytics services. Your use of those third-party services is subject to their respective terms and policies, which we do not control.
Apple App Store terms
You acknowledge that these Terms are between you and Bartr only, and not with Apple. Apple has no obligation to furnish maintenance or support for the Service. In the event of any failure of the Service to conform to applicable warranties, you may notify Apple and Apple will refund the purchase price (if any). Apple is a third-party beneficiary of these Terms for the purpose of enforcing them against you.
Termination
By you
You may stop using the Service at any time and delete your account from within the app or by emailing support@bartr.it.com.
By us
We may suspend or terminate your access to the Service at any time, with or without notice, if:
- You breach these Terms or our policies;
- We are required to do so by law, court order, or regulatory request;
- Your account is inactive for more than 24 months;
- We discontinue the Service in your region or entirely;
- We determine, in our sole discretion, that your continued use presents a safety or legal risk to other users or to Bartr.
Termination does not relieve you of obligations that by their nature survive — including §§ 04 (license to User Content for retained records), 09, 12, 13, 14, 15, and 16.
Disclaimers
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, Bartr disclaims all warranties including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and uninterrupted availability.
We do not warrant that:
- The Service will meet your requirements or expectations;
- Trades will be successful, safe, or result in items of a particular value;
- Other users will behave lawfully, honestly, or courteously;
- Listings are accurate, authentic, or legally tradeable;
- The Service will be free of errors, bugs, security vulnerabilities, or downtime.
Nothing in this section limits any rights you have as a consumer under mandatory provisions of the law of your country of residence.
Limitation of liability
To the maximum extent permitted by law:
- Bartr's total aggregate liability arising out of or related to these Terms or your use of the Service shall not exceed one hundred euros (€100) or the total fees you have paid to Bartr in the twelve months preceding the claim (whichever is greater). Because the Service is free, this will typically be €100.
- Bartr shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, lost opportunities, or damages arising from trades between users, in-person meetings, or reliance on listings.
- Bartr is not liable for the acts, omissions, or conduct of any user, including fraud, theft, violence, misrepresentation, or injury arising from in-person meet-ups.
Nothing in this section excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by gross negligence or intentional misconduct, or liability under mandatory consumer protection laws.
Indemnification
You agree to indemnify, defend, and hold harmless Bartr, its officers, directors, employees, contractors, and affiliates from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of or related to:
- Your breach of these Terms;
- Your User Content;
- Your trades or interactions with other users;
- Your violation of any law or the rights of any third party.
Bartr reserves the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to your indemnification, in which case you agree to cooperate with our defense.
Governing law and disputes
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles.
Any dispute, controversy, or claim arising out of or in connection with these Terms, including disputes regarding their existence, validity, or termination, shall be submitted to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands.
Nothing in this section prevents a consumer from bringing proceedings in the courts of their country of residence where required by mandatory consumer protection law, nor from filing a complaint with a relevant supervisory authority.
European consumers
The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obligated or willing to participate in a dispute resolution procedure before a consumer arbitration board.
Changes to these Terms
We may update these Terms from time to time. When we do:
- We will post the updated Terms at
https://bartr.it.com/terms; - We will update the "Effective" date at the top;
- For material changes, we will notify you via the app or by email at least 30 days before the new Terms take effect.
Your continued use of the Service after the effective date of the updated Terms constitutes acceptance. If you do not agree, you must stop using the Service and may delete your account.
